Default Cedar River

My closest body of water is the Cedar River and I was wondering how much of it is open to public hunting? I see where Cedar Co. made an island public hunting and so that is where my question is coming from. I was also wondering if you guys can give me some tips on structures to hunt and possible spread ideas. I'm trying to figure out where I can go and so I really appriciate the help.

If you are looking to hunt the Cedar during the urban season around waterloo, good luck. I talked with both the town and the DNR last year, and you cannot discharge a fire arm in city limits unless there is 40 acres of agricultural land you are hunting on, unless otherwise posted. Just an fyi.

Ok, there are navigable streams and meandered ones, meandered simply means they surveyed it in the original state survey and that makes it public up to the normal high water mark. Unfortunately they must have been in a hurry because there isn't much meandered.
This is a map of the meandered streams, I can't seem to find the verbal descriptions right now, the Cedar from Waterloo south is meandered.

http://www.iowadnr.gov/portals/idnr/...anderedmap.pdf

Then there's "navigable" streams which encompases almost any flowing water, the state owns the water and the streambed is privately owned.

from a 1996 attorney general's opinion:

Quote:
it is our opinion that members of the public may float on any navigable stream and engage in activities that are incident to navigation, including fishing, swimming, and wading. To the extent that hunting waterfowl in Iowa stream beds is customary, some particular types of waterfowl hunting might be considered as incidental to public recreational navigation.
we still don't know what "particular types" of waterfowl hunting that means, it would need to be tested in court.

Attorney General Opinion

Quote:
Courts in other jurisdictions have recognized a public right to hunt waterfowl from a boat on a stream flowing in a privately owned bed. Diana Shooting Club v. Husting, supra. However, generally, hunting is less likely than wading and fishing to be viewed as an incident of recreational navigation. To the extent that waterfowl hunting is customary in Iowa stream beds, some particular types of waterfowl hunting might be considered as incidental to public recreational navigation. It would not be appropriate for us to speculate on particular facts and circumstances which might make section 462A.69 relevant in a criminal trespass prosecution for hunting waterfowl in a privately-owned stream bed.

since it seems to be accepted practice to allow waterfowling, including decoy spreads on any decent sized water, it may be a long time before we have a definitive answer.

I wouldn't want to try to explain my interpretation of that law in court.

Yes. And chances are, at least 40 of your closest goose hunting buddies will be within a 1/4 mile of you.

Last year I think I counted 32 trailers in one boat ramp, packed on top each other. Glad I wasn't hunting, I'll just wait for the real season to begin.
